TERMS
Brook-Anco Corporation accepts all major credit cards including, VISA, MasterCard, and American Express. We also accept Government purchase orders. Information such as your current billing address and phone number is required in order to avoid any delays in processing your order. Please allow 24-72 Hours for Processing on all orders. Once your order is verified and ready to ship, we then charge your credit card.

• Money orders should be made out in US dollars.
• Personal and Company checks are acceptable when issued by a US bank.
• Purchase Orders are accepted, subject to verification and approval by our Credit Department at (800) 388-7566.
• Wire transfers are made possible by our Credit Dept. as well. Please call the above number for procedure guidance.

Total charges will include precisely what is indicated on our web site. It will comprise of the items ordered, plus shipping & handling based on shipping location. A local sales tax will be calculated on the total order of your merchandise when shipped within New York. Resale certificates and tax exempt forms should be faxed to our Credit Department at (585) 475-1942. No sales tax will be applied to orders shipped out of New York.  All applicable taxes will apply and be paid by the

ORDER PROCESSING
Any order confirmation (electronic or paper receipt) given to you through Brook-Anco does not signify our acceptance of your order, nor does it constitute confirmation of an offer to sell. Brook-Anco reserves the right to decline and cancel an order, or supply less than quantity ordered at any time.

We endeavor to publish accurate selling prices for the products we offer. However on occasion we do make mistakes. In the event a product is listed at an incorrect price or with incorrect information due to typographical error or error in pricing or product information received from our suppliers, Brook-Anco shall have the right to refuse or cancel any orders placed for products listed at the incorrect price. Brook-Anco shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, Brook-Anco shall immediately issue a credit to your credit card account in the amount of the charge. All promotions are subject to current stock. We reserve the right to cancel orders for promotional merchandise that we no longer have in stock. Prices are subject to change. Given the popularity and shortage of some items, we may at times have to restrict the quantity of a particular item ordered. We will notify you if we are unable to accommodate your order. Brook-Anco may, at its own discretion, limit or cancel quantities purchased per person, per household or per order. Please note, we may place a limit of promotions/gift cards to be used per order.

SHIPPING
Brook-Anco ships UPS and FEDEX ground 3-7 days or special shipping per request.

Brook-Anco Corporation exercises the utmost care in packaging to avoid damage. Our responsibility for arrival of merchandise in good condition is limited to F.O.B. point. Thereafter, carriers are responsible for loss or damage in transit. Claims for damage, both visual and concealed, or shortages should be reported to carrier within 10 days after receipt of merchandise.

Unless specific routing is indicated on customer’s order, Brook-Anco Corporation will determine route of shipment. Brook-Anco Corporation can ship to any business or residential area as long as a physical address is provided and the order passes all of our security regulations. We do not ship to PO BOXES.  All packages, regardless of its destination, require signature at delivery time. Shipping rates are based on zip code locations and calculated in shopping cart prior to checkout. Brook-Anco reserves the right to hold and/or delay any order indefinitely due to suspicion of fraudulent activity. We are required to charge NY Sales tax to all orders shipped within the state of NY. We do accept resale certificates, Tax exempt certificates from Non-Profit organizations.

RETURNS
No merchandise shall be returned without written authorization from Brook-Anco Corporation. Where merchandise is received and accepted for credit, a minimum restocking charge of 15% up to 40% shall be charged, depending on the condition, age and saleability of the merchandise. All authorized returns are to be shipped prepaid. Unauthorized returns will be refused and returned to shipper at his expense. Special orders are not subject to return.

Warranty Disclaimer and Limitations on Liability:

BROOK-ANCO PASSES THROUGH TO ITS CUSTOMERS ALL MANUFACTURERS WARRANTIES AND GUARANTEES THAT ARE PROVIDED FOR THE PRODUCTS IT SELLS. BROOK-ANCO MAKES NO ADDITIONAL OR INDEPENDENT WARRANTIES. TO THE FULL EXTENT PERMISSIBLE BY APPLICABLE LAW, BROOK-ANCO DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

BROOK-ANCO SHALL UNDER NO CIRCUMSTANCES BE LIABLE FOR SPECIAL, INCIDENTAL, CONSEQUENTIAL (INCLUDING LOST PROFITS OR OPPORTUNITIES) OR PUNITIVE DAMAGES, EVEN IF IT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE MAXIMUM LIABILITY OF BROOK-ANCO FOR ALL DAMAGES SHALL BE LIMITED TO AN AMOUNT NOT TO EXCEED THE PURCHASE PRICE OF THE PRODUCT. LIKEWISE, BROOK-ANCO WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF ITS CATALOG OR WEB SITE, INCLUDING, BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE AND CONSEQUENTIAL DAMAGES.
